Notice of Proposal

TSSA can issue a Notice of Proposal to revoke or suspend an authorization issued by TSSA.

TSSA issues a number of authorizations to regulated entities, facilities and businesses, including certificates, licences, registrations, permits and approvals.

The Technical Standards and Safety Act (TSS Act) gives TSSA the authority to suspend, revoke, refuse to grant or refuse to renew an authorization for the grounds listed in section 6(7) of the TSS Act.   

Notice of Proposal

If TSSA believes that one of these grounds exist, TSSA must first serve a Notice of Proposal (NOP) to take the proposed action on the applicant or authorization holder.

The NOP provides TSSA’s reasons for taking the proposed action. The applicant or authorization holder has the right to apply for a hearing before the Director to dispute the proposed action contained in the NOP.

To exercise this right, the applicant or authorization holder must request a hearing within 15 days after being served with the NOP, failing which the Director may carry out the proposed action stated in the NOP without further notice to the affected party.  

To request a hearing, complete at submit the Application for a Hearing for a Notice of Proposal (pdf) form. The Director will hold a hearing to decide whether to uphold the action proposed in the Notice of Proposal.

The Director may also provisionally suspend or refuse to renew an authorization without issuing an NOP or holding a hearing where in the director’s opinion, there is or would be an immediate threat to public safety. 

An applicant or authorization holder who is not satisfied with the Director’s decision following a hearing has the right to appeal that decision to the Divisional Court within 30 days of receiving the Director’s decision.
