Appeals

Any person affected by a TSSA inspector’s order or seal or who disputes the fees charged to them can file an appeal to TSSA.

TSSA inspectors are authorized to issue orders and apply seals to equipment prohibiting their use when they encounter non-compliances. TSSA also charges fees for certain inspections.

Any person affected by an inspector’s order or seal or who disputes the fees charged to them can submit an appeal within 90-days of receiving the order, seal, or fee invoice.

Formal and Informal Appeals

There are two appeal processes: formal and informal. As a formal appeal can be a lengthy, complex legal process, TSSA encourages you to pursue an informal resolution by contacting your local inspector or the regional supervisor or by calling us at 1-877-682-8772.

Order/Seal Appeals

An Order Appeal is an appeal of an inspector’s order regarding a contravention under the Act, a regulation, or a Minister’s Order.

An inspector’s order quotes specific violations of the Act, regulation, or code.

If you believe you were compliant, you can submit an appeal through the informal or formal appeal process.

Please note that submitting an appeal does not suspend the order. After the appeal hearing, the Director may change, revoke, or affirm an order.

A Seal Appeal is an appeal to have a seal removed from a device or equipment when the seal prohibits its use.

Filing an Order/Seal Appeal

Appeals must be made in writing, using Form A-1: Appeal of Inspector Orders/Seals (pdf). Please note that your appeal must be filed with the Director, within 90 days of the inspector’s issuing an Order or affixing a Seal, through the Hearings Coordinator at:

The appeal must be filed by hand delivery, registered mail, or courier.

Please ensure that Form A-1: Appeal of Inspector Orders/Seals (pdf) is complete. Attach the Order(s) (Inspection Report) which you are appealing. Incomplete forms or missing information may delay the processing of your appeal.

Normally an appeal involves two parties: the Appellant and the Inspector whose order or seal is being appealed. If an order is issued to multiple parties, each party may need to file its own appeal. 

You will receive a letter from the Hearings Coordinator confirming that your appeal has been successfully filed.

Fee Appeals

A Fee Appeal is an appeal of any fee being charged by TSSA.

TSSA charges fees on a cost-recovery basis as a not-for-profit administrative authority under provincial law. TSSA can refuse to grant or refuse to renew an authorization if you do not submit the required fee payments.

Appeals must be made in writing, using Form F-1: Appeal of the Requirement to Pay Fees (pdf). Please note that your appeal must be filed with the Director, within 90 days of the invoice date, through the Hearings Coordinator at:
