Label Requirements
All upholstered and stuffed articles offered for sale in Ontario must have an affixed label in a prescribed format as per Ontario Regulation 218/01 (Upholstered and Stuffed Articles).
Failure to properly label such items in accordance with the Act and Regulation will result in TSSA taking actions against the Seller as stipulated under the Regulation.
New Material Only" Label
The "New Material Only" label, affixed to an upholstered or stuffed article, confirms the article can be legally sold in Ontario. It identifies the filling material/s by generic name and must be new and clean. It also identifies the manufacturer's registration number.
The label must be securely affixed to all upholstered and stuffed articles before purchase by the consumer. If a "New Material Only" label cannot be located, contact TSSA at 1-877-682-TSSA (8772) or email at customerservices@tssa.org
Label Requirements for the sale of Second-Hand Upholstered and Stuffed Article
The Regulation defines a second-hand article as "an upholstered or stuffed article that has been purchased from a retailer, but does not include such an article if it's returned to the retailer before use with the original label attached."
The Regulation requires that an upholstered and stuffed article purchased and then returned to the seller be, in most instances, relabeled as second-hand prior to resale. This provides consumers with the information they need to make an informed decision.
Sellers, which include liquidators, auction houses, jobbers, retailers, distributors, hotels and pop-up stores, must affix the prescribed "Form 5 Second-Hand Article" label to the item in a conspicuous location.
