In accordance with the Technical Standards and Safety Act, any person affected by an inspector's order, seal or who has a dispute regarding fees can submit an appeal.
As of March 2017, appeals of all inspector seals, orders and/or fees must now be filed within 90-days of receiving a notice from the Technical Standards and Safety Authority (TSSA).
Appeals submitted after a 90-day period will no longer be considered.

Fee Appeal |
A Fee Appeal is an appeal of inspection fees being charged. TSSA charges fees on a cost-recovery basis as a not-for-profit administrative authority under provincial law. If considering a fee appeal, keep in mind that the time an inspector spends at a given site is only a small portion of the overall inspection cost. Other factors may include:

Please note that in accordance with the Technical Standards and Safety Act, the TSSA can refuse to grant or refuse to renew an authorization, if you don't submit the required fee payments. Order Appeal |
An Order Appeal is an appeal of an inspector's order regarding a contravention under the Act, regulations or Minister's Order. An inspector's order quotes specific violations of the Act, regulation or code. If you believe you were compliant, you can submit an appeal through the informal or formal appeal process. Please note that submitting an appeal does not suspend the order. After the appeal hearing, the Director may change, revoke or affirm an order. |
Seal Appeal |
A Seal Appeal is an appeal to have a seal removed from a device or equipment that denies its normal operation (whether subject to an authorization or not). |

There are two appeal processes - formal and informal. Before engaging in a formal appeal, which may be a lengthy legal process depending on complexity, you may consider an informal resolution by contacting your local inspector or the regional supervisor. |
